Board of Building Code Appeals

Purpose

The Board of Building Code Appeals will hear appeals from the owner, the owner's agent or any other person involved in the design, construction or maintenance of the structure which is appealing the Code Official's decision concerning application of the Uniform Statewide Building Code.

The Local Building Board of Appeals is a quasi-judicial body established under the State Code (Title 36, Chapter 6, Sec. 36-97 et seq.), to rule on disagreements between the local enforcers of the Virginia Uniform Statewide Building code and those persons being regulated under the code. Disagreements inevitably arise in the enforcement of any regulation. The Board of Appeals is established to provide a means of having a decision of a Building Official reviewed by an independent body to assure that the applicable code is being properly enforced.

Section 119.5 of the Uniform Statewide Building Code states that any person aggrieved by the local building departments application of the USBC or the refusal by to grant modification to the provisions of the USBC may appeal to the LBBCA.   Decisions of the LBBCA may be appealed to the State Review Board 

Day and Time of Meetings: Meetings are scheduled when appeals are applied for.
